Title: Commercial Manager

Job Overview:

McDermott is seeking a Project Commercial Manager who will assist in maximizing the commercial benefits and minimizing the commercial risks to McDermott through a detailed understanding of the Prime Contract and/or Joint Venture Agreement terms and conditions as well as related McDermott procedures. The Project Commercial Manager will assist in the planning and implementation of Prime Contract administrative systems or processes as appropriate to the Prime Contract requirements, project scope, size, value and complexity. They will provide contract management and administrative support to the Project Manager as well as to the managing committee of the Joint Venture Agreement.

KeyResponsibilities/Accountabilities:

  • Assist sales with theassessment of potential business opportunities, through proposaldevelopment and prime contract negotiation, formation, and award

  • Review the contract papertransmittal sales and assist during the contract handover to operations

  • Assist the project manager inproducing and maintaining the contract conditions summary

  • Prepare and maintain thecontract compliancematrix

  • Assist the project manager inpresenting and reviewing the prime contracts and JV agreements with theproject team

  • Prepare and deliver commercialawareness training to the project team leads

  • Participate in key issues andalignment meetings with the client and McDermott operationsmanagement

  • Participate in estimate andschedule handover meetings

  • Present the contract conditionsand contractual change management requirements to the project team leadsduring the project kick-off meeting

  • Prepare the prime contractmanagement plan with input from the project team

  • Provides input for thepreparation of the project execution strategy, as well as project plansand procedures that may impact prime contract management

  • Assist the project manager inconfirming client billing requirements and ensuring timely invoicing Workwith the finance manager, and the treasury group in checking thatinsurance coverage and financial guarantees are provided and maintained inaccordance with the prime contract terms

  • Coordinate the preparation offlow down provisions for procurement and subcontract management

  • Ensure that relevant contractsmanagement records (e.g. deliverables, correspondence, notices, clientapprovals, change orders, certificates, reports) are gathered, attributedand provided to Information management for inclusion into the EDMS

  • Administer the project commercialcorrespondence and client meetings

  • Participate with the projectmanager, project controls and technical staff in monthly project statusassessments, internal project meetings and client monthly progressmeetings

  • Provide input and reviewreports to client to ensure commercial accuracy

  • Identify, assess, respond andcontrol the prime contract and commercial risks in theproject

  • Monitor development andrevisions to the baseline and progress schedules to safeguard McDermott’sentitlement for extensions of time resulting from changes and delays

  • Ensure contract noticecompliance to preserve contractual and legal rights

  • Support the project managerwith prime contract change control and claim management

  • Assist the project manager toestablish, and communicate the prime contract baseline to the project team

  • Assist in maintaining the primecontract baseline as modified by change orders and amendments duringproject execution

  • Monitor and provide assistancewith the identification and processing of changes

  • Assist in the preparation,presentation and negotiation of change order requests, and change orders

  • Work with claims, legal, andoperations management to avoid, report and resolve claims and disputeswith the client, subcontractors, suppliers, and/or JV partners

  • Support warranty management andmaintain the warranty claims log

  • Assist in functionalassessments and the continuous improvement process

  • Assist the project manager withclosing out the prime contract

Basic Qualifications:

  • Knowledge of contracting lawsand regulations, standards of conduct, contract types, contractingmethods, financial and legalmatters

  • Experience in acquisitionplanning, drafting requests for price, proposal preparation, negotiations,and source selection

  • Experience in projectinitiation, contract administration, change management, claims anddisputes, and contract closeout

  • Experience in the oil & gasEPC Industry

  • Well-developed skills withMicrosoft Excel and Word with general software operation knowledge

  • Strong safety, health, andenvironmental values

  • Highly developed timemanagement ability, to ensure deadlines are met

Desired/PreferredQualifications:

  • Bachelor’s Degree inEngineering, Law, Business, Quantity Surveying, or similar

  • Minimum 14 years ofEPC Project Contract Management experience Or 18 years of EPC ProjectContract Management experience

  • Contract management experiencein the power industry

  • Experience in lump sum primecontract management

  • Willingness to travel andrelocate to construction jobsites
